Murder suspect denies accusations of killing Kelly Dwyer

Prosecutors: ‘Mountain of evidence' against Zocco

The man accused in the death of Kelly Dwyer faced homicide charges in a Milwaukee County courthouse Tuesday.

Kris Zocco was transferred from prison in Waupun where he is serving time for child pornography convictions.

Zocco’s defense attorney Craig Mastantuono says Zocco, “completely denies all allegations.” He is charged with first degree reckless homicide, hiding a corpse, and strangulation and suffocation.

The criminal complaint released Monday alleges that Zocco killed Dwyer during a violent sex act and then dumped her body in rural Jefferson County. The complaint relies heavily on witness statements to piece together the charges.

Mastantuono calls it circumstantial and says, “the complaint itself is an exercise essentially in the process of elimination… We don’t prosecute people by process of elimination. We don’t say no one else could have done it so it must have been this person.”

Prosecutors admit there is a lot of circumstantial evidence in the case, calling it a “mountain of evidence.” Sara Beth Lewis said, “all of the pieces taken as a whole make it clear that there isn’t any other person possible that could be responsible for Kelly Dwyer’s death.”

Commissioner Barry Phillips agreed there is enough probable cause to move forward and set a preliminary hearing for May 18.
